Terms of Use

1.        Introduction

1.1. The Singapore Tourism Board (“STB”) maintains this website for the convenience of the public. By accessing and using this website and/or any content, services, features or tools made available by this website, you unconditionally agree to be bound by these terms of use, which may be updated and amended from time to time at STB’s sole and absolute discretion (these “Terms of Use”). All changes will be posted on this website and your use of this website after such changes have been posted will constitute your agreement to the modified Terms of Use. You should therefore read the Terms of Use carefully each time you visit this website. In these Terms of Use, the term “this website” means the Tourism Information & Services Hub, including the developer portal.

1.2. If you are using this website on behalf of any entity, you accept these terms on behalf of such entity and warrant that you are authorised to do so. All references in these Terms of Use to “you” or wording of similar meaning shall refer to the entity on whose behalf you have accepted these Terms of Use.

2.        Age Restrictions

2.1. Except as stated in this Clause 2, you must be 16 years of age or older to use this website and the Content and/or to register for a User Account, and you warrant that you satisfy this age requirement and are lawfully able to accept these Terms of Use.

3.        Ownership of Website

3.1. This website is owned and operated by STB. All content displayed or made available on this website, including, without limitation, all text (which shall include any feedback submitted by any User through this website), data, graphics, images, illustrations, sounds, multimedia works, photographs and videos (the “Content”), is owned by, licensed to or controlled by STB and is protected by copyright, moral rights, trademark and other laws and/or international treaties for the protection of intellectual property.

3.2. Use of the Content is expressly prohibited except in accordance with these Terms of Use. Any contravention of these Terms of Use may result in severe civil and criminal penalties.

3.3. All software, including, without limitation, Application Programme Interface software (“API”), widgets, plug-ins and tools, and accompanying documentation made available on or from this website (collectively the “Software Tools”) and the source and object codes, format, directories, queries, algorithms, structure and organisation of such Software Tools are proprietary to STB and/or its suppliers. Ownership of intellectual property rights in and to the Software Tools is retained by STB and its suppliers and you only have a non-exclusive licence to use the same. The use of any such Software Tools may be subject to a licence granted by STB or the relevant copyright owner(s) which you are required to read and comply with. Without prejudice to the generality of the foregoing, STB offers API subject to the terms and conditions set out in Clause 7 and 8 (where applicable) of these Terms of Use.

3.4. The design and layout of this website are protected by intellectual property and other laws and shall not be copied, imitated or used in whole or in part without the prior written permission of STB or the respective rights owners.

3.5. All rights not expressly granted under these Terms of Use are reserved by STB and its licensors.

4.        Symbols and Marks

4.1. A depiction of the Merlion symbol and STB’s corporate logo (the “Symbols”), are protected by the Singapore Tourism Board Act (Chapter 305B), and any unauthorised use of the Symbols or representations closely resembling them are offences which may be punishable under the law.

4.2. Other marks, logos or branding of STB used on this website (the “Marks”) may be registered trademarks of STB. Other product and company names mentioned herein may also be the registered trademarks of their respective owners.

4.3. STB’s name, the Symbols, Marks and other marks and names displayed or used on this website may not be copied, imitated or used in whole or in part without the prior written permission of STB or the respective rights owners. STB and/or the relevant proprietors will not hesitate to take action against any unauthorised usage of STB’s name, the Symbols, Marks and other marks and names referred to herein.

5.        Use of the Website

5.1. You shall not do or permit any other party to do any of the following in respect of this website:

(a) Download, copy, modify, host, stream, sublicense, or resell any or all of this website or Content except as otherwise expressly allowed in these Terms of Use.

(b) Use any data mining, robots or data gathering, data monitoring or data extraction methods or otherwise take any action that imposes a disproportionately large or unreasonable load on STB’s servers.

(c) Reverse engineer any part of this website or Content.

(d) Manipulate or otherwise display this website or any Content by using framing or similar navigational technology.

(e) Attempt to disable, impair, or destroy this website or Content or submit, upload or transmit any content which contains any virus or other malicious, destructive or corrupting code, programme or macro.

(f) Register, subscribe, unsubscribe, or attempt to register, subscribe, or unsubscribe yourself or any party for any Content or other product or service offered on this website if you are not expressly eligible or authorized by such party to do so.

(g) Circumvent, disable or otherwise interfere with any access or use restrictions or security features of this website or any resources, services or networks connected to or accessible through this website.

(h) Enable or allow others to use your User Account or Registration Data (defined in Clause 6).

(i) Impersonate any party or otherwise misrepresent your affiliation with or authorisation by any party.

(j) Access or attempt to access this website or Content by any means other than the interfaces or Software Tools provided or authorized by STB.

(k) Violate or attempt to violate any applicable law, third party rights (including, without limitation, intellectual property rights, moral rights and right to privacy) or industry codes.

6.        User Account

6.1. Certain Content and Software Tools are only accessible with a user account (the “User Account”). If you apply for a User Account, you agree to: (a) provide accurate, current and complete information about you as may be required by STB (the "Registration Data"); (b) maintain and promptly update the Registration Data to keep it accurate, current and complete; (c) be solely responsible for maintaining the security of your account information; and (d) accept responsibility for any and all activities that occur under your User Account. STB is entitled to treat all activities that occur under your User Account as having been conducted with your knowledge and authority.

6.2. STB reserves the right, without prior notice and without liability to any party, to reject your application for a User Account without having to provide you with any reason for such rejection, and/or to limit, suspend, deactivate or terminate your User Account or any of your rights as a User Account holder if you are in breach of these Terms of Use or otherwise in STB’s sole and absolute discretion at any time and without assigning any reason.

7.        API

7.1. STB may offer API for you to access, use and display Content in your application(s) and website(s), to submit Content to this website, to receive services from STB or third party suppliers, and/or to receive personal data from a Visit Singapore Account User (the "VS Account User") and E-Visitor Authentication (EVA). The provisions of this Clause 7 apply if you access and/or use such API.

7.2. Notwithstanding Clause 7.1, in no event shall STB be obliged to provide, or continue to provide, any API, now or in the future. STB shall not be liable to you or any third party for any modification, suspension or termination of any API or your access to or use of such API.

7.3. In no event shall STB be obliged to make available any updates, upgrades, modifications and/or patches in relation to the API or provide any maintenance, support, and/or other services (including, without limitation, error corrections, bug fixes, and enhancements) or documentation in relation to the API. However, in the event that STB makes available any updates, upgrades, modifications and/or patches, you shall install the same to keep your installation of the API updated to the most recent release. A reference in these Terms of Use to such API shall include a reference to any updates, upgrades, modifications and/or patches made available in relation to the API.

7.4. You warrant that any information which you have provided in order to obtain the API is accurate and complete for the duration of your access and/or use of the API.

7.5. Subject to these Terms of Use and any applicable Specific Terms, STB grants you a limited, royalty-free, non-exclusive, personal, revocable, non-sub-licensable, and non-transferable license to use the API.

7.6. You shall not do or permit any other party to do any of the following in respect of the API:

(a) Use the API except for the purpose(s) described in this website in relation to such API;

(b) Modify, adapt, improve, enhance, alter, or create derivative works of source codes of the API;

(c) Use or merge the source codes of the API, or any component or element thereof, with other software, databases, and/or services not authorised by STB;

(d) Sell, licence, share, distribute, lease, rent, loan or otherwise transfer or deal with, whether commercially or otherwise, the source codes of the API to or with a third party;

(e) Use the API as part of a service bureau;

(f) Reverse engineer, decompile, decrypt, disassemble, or otherwise attempt to derive the source code or structure of the API;

(g) Circumvent, or attempt to circumvent, any electronic protection measures in place to regulate or control the access to and use of the API;

(h) Access or use the API in a manner which is in violation of any applicable law, third party rights (including, without limitation, intellectual property rights, moral rights and right to privacy) or industry codes;

(i) Perform any action with the intent of introducing into the API viruses, worms, defects, trojan horses, malware, or any items of a destructive nature;

(j) Develop, distribute or sell any software or other functionality capable of launching, being launched from, or otherwise integrated with the source codes of the API; or

(k) Remove, alter, or obscure any copyright notice or any other proprietary notice that appears on or in the API.

7.7. STB may at any time, at its sole and absolute discretion without prior notice and without liability to any party and without assigning any reason, forthwith suspend or terminate your access to and use of all or part of the API. STB may also suspend or terminate your access and/or use of the API forthwith without prior notice and without liability to any party if you breach these Terms of Use.

7.8. STB reserves the right to modify, revise, amend or remove from your website(s) and/or application(s) the Content in whole or in part without prior notice in the event of (a) the suspension or termination of your access to and/or use of the API or any part thereof, (b) your breach of these Terms of Use, or (c) for any other purpose that STB may deem fit in its sole and absolute discretion without assigning any reason.

7.9. Notwithstanding Clause 7.8 above, upon suspension or termination of your access and/or use of the API, you shall immediately remove and delete the API from all computers, hard drives, networks, and other storage media in your possession or under your control, along with any related documentation (and any copies thereof) that you may have received or otherwise may possess and, if required by STB, certify in writing that you have completed such removal and deletion.

7.10. You agree to make provisions for your website(s) and/or application(s) to receive updates from time to time, and you acknowledge that it is your responsibility to ensure that your website(s) and application(s) are up-to-date.

7.11. You are solely responsible for obtaining and maintaining all telecommunications, broadband, software, hardware, equipment, and services needed to access and/or use the API, and for paying all charges related thereto.

7.12. In choosing to access and/or use the API, you agree to do so on your own initiative and at your own risk, and you are responsible for complying with all applicable laws, rules and regulations.

8.            VS Account API Obligations

8.1. This Clause 8 specifies additional terms that apply to the use of the Visit Singapore Account API (the “VS Account API”).

8.2. You may use the VS Account API to enable a quick log in to your application and build insights on VS Account Users’ profiles by retrieving personal data of a VS Account User submitted through his Visit Singapore Account (the “VS Account Identification Data”), through the VS Account Linkup subject to these Terms of Use. "VS Account Linkup" means linking your applications through the VS Account API for the purpose of allowing VS Account User to retrieve the VS Account Identification Data from his Visit Singapore Account profile in connection with the services that you provide.

8.3. You shall submit all necessary information as may be required by STB in connection with your application for the VS Account API. You warrant that any information which you have provided in order to obtain the API is accurate and complete for the duration of your access and/or use of the API.  In the event of any inaccurate, false or misleading information submitted for purposes of such application, you agree that STB shall have the right (in addition to and without prejudice to all other remedies available, including the right to claim damages) to forthwith suspend or terminate your access to and use of all or part of the API.

8.4. STB reserves the right, without prior notice and without liability to any party, to reject your application for the VS Account API without having to provide you with any reason for such rejection, and/or to limit, suspend, deactivate or terminate your access to the VS Account API if you are in breach of these Terms of Use or otherwise in STB’s sole and absolute discretion at any time and without assigning any reason.

8.5. You shall take all reasonable measures to ensure that the VS Account Identification Data is protected against loss or damage (whether accidental or otherwise), and against unauthorised access, use, modification, disclosure or other misuse and that only authorised personnel have access to the VS Account Identification Data. You shall comply with all applicable laws in relation to personal data and VS Account Identification Data (including, without limitation, any restrictions against cross-border transfer of personal data). You shall immediately notify STB when you become aware of a breach of this Clause 8.5.

8.6. You shall adhere to, and shall ensure that the VS Account Linkup and all of your applications linked through the VS Account API adheres to, the VS Account API Guidelines.

8.7. You:

(a) acknowledge and agree that STB may amend the VS Account API Guidelines at any time and from time to time by updating the TIH developer portal;

(b) shall be responsible for checking the developer portal for amendments to the VS Account API Guidelines, and shall be bound by all amendments to the VS Account API Guidelines published on the developer portal or otherwise notified to you; and

(c) shall make all necessary modifications to the VS Account Linkup and all of your applications linked through the VS Account API to ensure adherence to the VS Account API Guidelines at all times.

8.8. You shall ensure that the VS Account Linkup uses the API in such manner prescribed by the VS Account API Guidelines to ensure that (a) user authentication is achieved; and (b) all user consents necessary for the disclosure of the VS Account Identification Data to you is obtained.

8.9. You acknowledge and agree that (a) the VS Account User who has provided his VS Account Identification Data is responsible for ensuring that the personal data provided in his Visit Singapore Account profile remains factually accurate and complete, (b) you shall comply with all lawful requests of the VS Account User in relation to his personal data (including, without limitation, requests to rectify or delete the personal data), (c) you shall comply with all lawful requests of a regulatory authority having jurisdiction over personal data protection, and (d) STB shall not be liable for any inaccuracies in or incompleteness of any such personal data.

8.10. If STB is of the opinion that you are in breach of this Clause 8, STB shall have the right to instruct you to (a) make all necessary modifications to the VS Account Linkup and all its applications linked to the VS Account API to ensure adherence to the VS Account API Guidelines, and (b) take all necessary actions to comply with personal data requirements under any applicable laws, and you shall comply with such instructions.

9.            E-Visitor Authentication (EVA) API Obligations

9.1. This Clause 9 specifies additional terms that apply to the use of the E-Visitor Authentication APIs (the “EVA API”).

9.2. Hotels shall only use the EVA API to automate the authentication of the immigration status of hotel guests (excluding Singapore Citizens and Permanent Residents) in Singapore as part of the hotel check-in process. The EVA API shall only be used as part of a self check-in solution (e.g. mobile application or physical kiosk) that is equipped with facial recognition technology to verify the identity of guests by matching the face of each guest against the passport photograph of the guest. After identity verification has been performed, hotels shall, through the EVA API, immediately send the self check-in data to ICA for a back-end check of the immigration status of the guests in Singapore.

9.3. Hotels shall ensure that the facial recognition technology adequately matches each guest’s physical facial features against the guest’s passport photograph. The verification of the guest’s identity must take place at the point of check-in to the hotel within the hotel premises at which the guest has sought accommodation, and before the guest is allowed to occupy a room in the hotel premises. To avoid doubt, in the event that a guest’s physical facial features do not match the guest’s passport photograph, the hotel must refuse to allow the guest to occupy any room in the hotel.

9.4. As part of the EVA API integration, hotels shall obtain the explicit and genuine consent of guests for their personal data to be collected, used, disclosed and stored by STB and the Singapore Immigrations & Checkpoints Authority (ICA) for the purposes of guest authentication required under the Hotels Licensing Regulations, Immigration Act and National Registration Regulations.

9.5. Hotels shall take all reasonable measures to ensure that the data collected as part of the self check-in solution is protected against loss or damage (whether accidental or otherwise), and against unauthorised access, use, modification, disclosure or other misuse. Hotels shall comply with all applicable laws in relation to personal data (including, without limitation, any restrictions against cross-border transfer of personal data). Hotels shall immediately notify STB upon becoming aware of a breach of this Clause 9.5. Hotels agree that STB shall have the right to suspend or terminate access to and use of all or part of the API, until the data breach has been resolved.

9.6. Hotels shall submit all necessary information as may be required by STB in connection with applications for the EVA API. Hotels warrant that any information which you have provided in order to obtain the API is accurate and complete for the duration of your access and/or use of the API.  In the event of any inaccurate, false or misleading information submitted for purposes of such application, hotels agree that STB shall have the right (in addition to and without prejudice to all other remedies available, including the right to claim damages) to forthwith suspend or terminate access to and use of all or part of the API.

9.7. STB reserves the right, without prior notice and without liability to any party, to reject a hotel’s application for the EVA API without having to provide any reason for such rejection, and/or to limit, suspend, deactivate or terminate access to the EVA API if a hotel is in breach of these Terms of Use or otherwise in STB’s sole and absolute discretion at any time and without assigning any reason.

9.8 Any discovered security breaches of the self check-in solution that uses the EVA API, must be reported to STB immediately. You agree that STB shall have the right to forthwith suspend or terminate your access to and use of all or part of the EVA API, until the security breach has been resolved.

9.9. You:

(a) acknowledge and agree that STB may amend the EVA API Guidelines at any time and from time to time by updating the TIH developer portal;

(b) shall be responsible for checking the developer portal for amendments to the EVA API Guidelines, and shall be bound by all amendments to the EVA API Guidelines published on the developer portal or otherwise notified to you; and

(c) shall make all necessary modifications to the EVA API and all of your applications linked through the EVA API to ensure adherence to the EVA API Guidelines at all times.

(d) shall conduct the necessary User Acceptance Testing (UAT) where there are changes to the self check-in solution that affects the EVA API integration or/and modifications to the EVA API.

9.10. Hotels shall comply with all lawful requests of regulatory authorities having jurisdiction over personal data protection, hotels, immigration and/or law enforcement.

9.11. If STB is of the opinion that you are in breach of this Clause 9, STB shall have the right to instruct you to (a) make all necessary modifications to the EVA integration and all its applications linked to the EVA API to ensure adherence to the EVA API Guidelines, and (b) take all necessary actions to comply with personal data requirements under any applicable laws, and you shall comply with such instructions.

10.        Use of Content

10.1. Subject to these Terms of Use and the applicable Specific Terms (defined below), if any, STB grants you a revocable, non-exclusive, non-sub-licensable, non-transferable licence to use the Content without geographical restriction or end date. This licence is royalty-free, meaning you need not pay STB or its suppliers to use the Content.

10.2. In relation to the Content, the term “use” means the reproduction, modification, editing, performance, display, broadcast, publication and distribution.

10.3. Some Content may be subject to additional or specific terms and conditions displayed elsewhere on this website (the “Specific Terms”). Specific Terms may restrict your use of the Content. If you intend to use such Content, you must comply with the applicable Specific Terms. These and the Specific Terms may be updated and amended from time to time at STB’s sole and absolute discretion. All changes will be posted on this website and your use of this website and/or the Content after such changes have been posted will constitute your agreement to the modified Specific Terms. If there is any conflict or inconsistency between these Terms of Use and the Specific Terms, the Specific Terms shall prevail. All references herein to “Terms of Use” shall be construed as a reference to the Terms of Use, subject to the Specific Terms.

10.4. The Content which is available to you for access and use depends on the category of User Account you have signed up for. You will not have the right to access or use Content that is not available to your User Account category.

10.5. Any violation of these Terms of Use shall automatically revoke the licence granted to you under this Clause 10 with immediate effect and you shall immediately and at your own cost and expense: (a) cease using all Content, (b) delete or destroy any copies of all Content in your possession or under your control, and (c) if required by STB, confirm in writing that you have complied with these requirements. Failure to comply with such obligation may result in severe civil or criminal penalties.

10.6. STB reserves the right to revoke or discontinue the licensing of any Content at any time at its sole and absolute discretion without prior notice and without liability to any party and without assigning any reason. In the event of the revocation or discontinuation of the licensing of any item of Content, you shall immediately at your own cost and expense: (a) cease using the relevant item of Content, (b) delete or destroy any copies of the relevant item of Content in your possession or under your control, and (c) if required by STB, confirm in writing that you have complied with these requirements. Failure to comply with such obligation may result in severe civil or criminal penalties.

10.7. You may allow sub-contractors or service providers to use the Content on your behalf, provided that you ensure their use of the Content does not violate these Terms of Use. You accept liability for any such violation by your sub-contractors and service providers as though you yourself committed those violations.

10.8. Notwithstanding any provision of these Terms of Use, if, as a result of your use of the Content, any fee shall become due and payable to the relevant performing, mechanical, or other rights society or societies that collects and administers royalty payments or similar remuneration on behalf of music publishers, writers and performers anywhere in the world (collectively the “Collection Societies”), you shall be solely responsible for paying such fees to the relevant Collection Societies.

11.         Restrictions on Use of Content

11.1. You shall not do or permit any other party to do any of the following in respect of any Content:

(a) Use the Content in any manner which (1) is defamatory, libellous or slanderous, inflammatory or threatening, obscene, indecent, pornographic or profane, fraudulent, intentionally misleading or intentionally erroneous, or (2) is in violation of any applicable law, third party rights (including, without limitation, intellectual property rights, moral rights and right to privacy) or industry codes or (3) will subject or be likely to subject STB to any form of liability.

(b) Use the Content in or on any website, online platform, publication or object of any kind (including, without limitation, any book, magazine or periodical, any sound recording or film, any picture, drawing or photograph and any merchandise) which embodies in whole or in part matter which is defamatory, libellous or slanderous, inflammatory or threatening, obscene, indecent, pornographic or profane, fraudulent, intentionally misleading or intentionally erroneous.

(c) Use the Content in any manner prejudicial to the interests of STB or its suppliers or the interests of Singapore.

(d) Manipulate, modify, process or otherwise use the Content in any manner that may distort the contextual integrity of the Content.

(e) Sell, licence, share, distribute or deal with, whether commercially or otherwise, the Content as a standalone file or as part of a database or other product or service which invites others to download, extract, or redistribute content as a standalone file or an electronic template.

(f) Falsely attribute the authorship of the Content.

(g) Use the Content as part of a trademark, design mark, tradename, business name, service mark, or logo.

11.2. Any doubt or disagreement as to whether any provision of Clause 11.1 has been violated shall be resolved by STB whose decision shall be final.

12       Submission of Content

12.1. Your User Account may allow you to submit Content to this website for access and use by others.

12.2. If you submit any Content (including any feedback) to this website, you irrevocably and unconditionally grant to STB, its successors-in-title and assigns, a non-exclusive, non-terminable, fully sub-licensable, fully transferable, royalty-free licence to use the Content without geographical restriction or expiry date in any and all media now in existence or which may be developed in the future for an unlimited number of times and without any expiration or end date for the following purposes:

(a) To make available the Content on this website or anywhere else from time to time for access and use by third parties for any purposes whatsoever, whether commercial or non-commercial, subject to these Terms of Use or such other terms as STB may deem fit to impose from time to time.

(b) To market and promote the Content to third parties.

(c) To use the Content for STB’s business purposes, including, without limitation, to develop and promote Singapore as a travel and tourist destination, to advise the Singapore Government and other parties on matters relating to travel and tourism, and to enhance the travel and tourism sector’s contribution to the Singapore economy.

12.3. The term “use” in Clause 12.2 means all manner of use of the Content, including, without limitation, the reproduction, performance, display, broadcast, publication, distribution, synchronisation, modification, adaptation, editing, translation, creation of derivative works and incorporation in or with any other works.

12.4. If you submit any Content to this website, you irrevocably and unconditionally grant to STB, its successors-in-title and assigns and all its and their sub-licensees the right to use the name(s), likeness, image(s), characterisation and biographical content provided by you, and your registered and unregistered trademarks, to identify you and allow third parties to identify you as the source of such Content or for any other purposes which STB may deem fit from time to time. Without prejudice to the generality of the foregoing, STB may use such name(s), likeness, image(s), characterisation and biographical content and trademarks, in print and for and on any page on websites owned or controlled by STB, including, without limitation, www.visitsingapore.com and www.stb.gov.sg, STB’s social media platforms, including, without limitation, Facebook and Twitter, software applications made available by STB, and third party websites and third party applications, whether as individual or collective works or in combination with other works of STB or third parties. However, you acknowledge and accept that neither STB nor any other party shall be obliged to credit you when using such name(s), likeness, image(s), characterisation and biographical content or trademarks or credit you as the source of any Content, and shall have no liability for any failure to give such credit.

12.5. STB reserves the right without prior notice or liability to remove any Content you have submitted in whole or in part, to restrict the access of other users of this website to such Content, or to require you to make changes to such Content in STB’s sole and absolute discretion at any time and without assigning any reason.

12.6. The licence granted under Clause 12.2 shall survive any limit, suspension, deactivation or termination of your User Account or any of your rights as a User Account holder or any removal of Content from this website, whether by you or STB or any suspension or termination of your access to and/or use of the API pursuant to Clause 7.7.

12.7. STB may allow sub-contractors or service providers to use the Content on its behalf, provided STB ensures that their use of the Content does not violate these Terms of Use and accepts liability for any such violation by its sub-contractors and service providers.

12.8. You hereby waive, and confirm that all relevant authors have waived, all moral rights which subsist in respect of the Content you have submitted and, so far as is legally possible, any broadly equivalent rights as may exist in any territory of the world. If no such waiver is permitted under any applicable law, you agree that you shall not enforce, and will procure that all relevant authors do not enforce, such rights against STB or its licensees of the Content.

12.9. Notwithstanding any provision of these Terms of Use, you acknowledge and accept that STB is not responsible for any consequences of your supply of Content to this website. Content may be used in connection with sensitive topics and/or may be used in ways that may be controversial or unflattering or in violation of the terms of use imposed by STB. STB takes no responsibility and assumes no liability to you or any person claiming through you for the manner of use of Content by third parties, including, without limitation, any licensees of STB. 21.       General
